Article D6323-4 of the French Labour Code

I.-Employees wishing to take part in a training course referred to in article L. 6323-6 that is followed in whole or in part during working hours under the personal training account must submit a request for leave of absence to the employer before the start of the training course, within a period that may not be less than :

1° Sixty calendar days if the duration of the training course is less than six months;

2° One hundred and twenty calendar days if the duration of the training course is six months or more.

II – From receipt of the request, the employer has thirty calendar days to notify the employee of its response. If the employer does not respond within this period, this will be deemed to be acceptance of the request.

I.-Le salarié qui souhaite bénéficier d’une action mentionnée à l’article L. 6323-6 suivie en tout ou partie pendant le temps de travail au titre du compte personnel de formation adresse une demande d’autorisation d’absence à l’employeur avant le début de l’action de formation dans un délai qui ne peut être inférieur à :


1° Soixante jours calendaires si la durée de l’action de formation est inférieure à six mois ;


2° Cent vingt jours calendaires si la durée de l’action de formation est égale ou supérieure à six mois.


II.-A compter de la réception de la demande, l’employeur dispose d’un délai de trente jours calendaires pour notifier sa réponse au salarié. L’absence de réponse de l’employeur dans ce délai vaut acceptation de la demande.
