Article D6323-9-2 of the French Labour Code

In order to benefit from a professional transition project under the conditions mentioned in the third paragraph of article L. 6323-17-1 of the French Labour Code, the employee must prove that:

1° The seniority conditions required in articles R. 6323-9 and R. 6323-9-1 apply to occupations covered by the mapping of occupations and activities mentioned in III of article L. 221-1-5.

2° The occupation targeted by the training is not exposed to the occupational risk factors mentioned in article L. 4161-1.

3° The professional transition project is co-financed by the employer. The amount of this co-financing must correspond at least to a rate set by order of the Minister responsible for vocational training.

In order to submit his application, the employee may benefit from prior support from one of the operators financed by the body mentioned in article L. 6123-5 as part of the professional development advice mentioned in article L. 6111-6.

Pour bénéficier d’un projet de transition professionnelle dans les conditions mentionnées au troisième alinéa de l’article L. 6323-17-1 du code du travail, le salarié doit justifier que :

1° Les conditions d’ancienneté requises aux articles R. 6323-9 et R. 6323-9-1 s’appliquent à des métiers relevant de la cartographie des métiers et des activités mentionnée au III de l’article L. 221-1-5.

2° Le métier visé par la formation n’est pas exposé aux facteurs de risques professionnels mentionnés à l’article L. 4161-1.

3° Le projet de transition professionnelle fait l’objet d’un cofinancement assuré par son employeur. Le montant de ce cofinancement doit correspondre au minimum à un taux fixé par arrêté du ministre chargé de la formation professionnelle.

Pour présenter sa demande, le salarié peut bénéficier d’un accompagnement préalable par l’un des opérateurs financés par l’organisme mentionné à l’article L. 6123-5 au titre du conseil en évolution professionnelle mentionné à l’article L. 6111-6.
