Any councillor to the Assembly of Martinique or any executive councillor in receipt of official allowances and who is unable, in the event of illness, maternity, paternity or accident, to effectively carry out his duties beyond a period of fifteen clear days, is required to inform the territorial authority of Martinique of the amount of his daily allowances which are, where applicable, paid by his social security scheme in respect of his professional activity, accompanied by supporting documents concerning the stoppage of work and its compensation, in order to determine the amount of the functional allowances to be awarded to him in accordance with Article L. 7227-27.
In the event of an overpayment, the local authority shall proceed to recover the undue amount from the date of receipt of the daily allowances by the elected official and the declaration of their amount.
When the elected official does not benefit from any daily allowance scheme or does not meet the conditions for receiving compensation from the social security scheme to which he/she belongs, the official’s allowances are maintained in full for the duration of the work stoppage.
In the event of multiple mandates, the provisions of the first paragraph of this article shall apply to each mandate.
