Article D762-12 of the French Monetary and Financial Code

I. – Article D. 440-3, with the exception of the sixth and seventh paragraphs, is applicable in New Caledonia, subject to the adaptations provided for in II, in the version resulting from Decree no. 2019-1097 of 20 August 2019.
II. – For the application of I, in Article D. 440-3:
1° The words: “in accordance with Directive 2009/65/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of laws, regulations and administrative provisions relating to undertakings for collective investment in transferable securities” are deleted;
2° The words: “within the meaning of Article 4(1)(a) of Directive 2011/61/EU” and the words: “within the meaning of Article 111 of Commission Delegated Regulation No 231/2013 of 19 December 2012” are deleted.

I. – L’article D. 440-3 à l’exception des sixième et septième alinéas est applicable en Nouvelle-Calédonie, sous réserve des adaptations prévues au II, dans sa rédaction résultant du décret n° 2019-1097 du 20 août 2019.
II. – Pour l’application du I, à l’article D. 440-3 :
1° Les mots : « conformément à la directive 2009/65/ CE du Parlement européen et du Conseil du 13 juillet 2009 portant coordination des dispositions législatives, réglementaires et administratives concernant certains organismes de placement collectif en valeurs mobilières » sont supprimés ;
2° Les mots : « au sens de l’article 4, paragraphe 1, point a, de la directive 2011/61/ UE » et les mots : « au sens de l’article 111 du règlement délégué n° 231/2013 de la Commission du 19 décembre 2012 » sont supprimés.
