Article D8254-6 of the French Labour Code

Any enforcement officer who observes the recruitment or employment of a foreign national who does not hold a permit authorising him or her to work as an employee in France by the co-contractor referred to in article D. 8254-2, shall ascertain from the person to whom this same article applies that the co-contractor has provided him or her with a list of the names of foreign employees subject to work permits.
Where this list has not been provided, the inspecting officer shall mention this in the report provided for in article L. 8271-17 or in a notice attached thereto, specifying:
1° The identity and address of each of the persons concerned;
2° The purpose and amount of each of the contracts that they have entered into in breach of the obligations provided for in article L. 8254-1.
A copy of the report and, where applicable, the notice are sent to the Regional Director of Companies, Competition, Consumer Affairs, Labour and Employment.

L’agent de contrôle qui constate l’embauche ou l’emploi d’un étranger non muni d’un titre l’autorisant à exercer une activité salariée en France par le cocontractant prévu à l’article D. 8254-2, s’assure auprès de la personne à laquelle ce même article est applicable qu’elle s’est fait remettre par ce cocontractant la liste nominative des salariés étrangers soumis à autorisation de travail.
Lorsque cette liste n’a pas été remise, l’agent de contrôle le mentionne dans le procès-verbal prévu à l’article L. 8271-17 ou dans une notice qui lui est annexée en précisant :
1° L’identité et l’adresse de chacune des personnes intéressées ;
2° L’objet et le montant de chacun des contrats qu’elles ont conclus en méconnaissance des obligations prévues à l’article L. 8254-1.
Un exemplaire du procès-verbal et, le cas échéant, de la notice sont adressés au directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi.
