Article D8261-2 of the French Labour Code

When the labour inspector or controller has reason to believe, based in particular on the conditions under which the work of all or some of the employees employed in a company is organised, that this employment constitutes a breach of both the prohibition on concurrent employment provided for in article L. 8261-1 and the derogation provided for in article L. 8261-3, he may ask the employer to require the designated employees to provide a written attestation certifying that they are not in breach of these same provisions or of those relating to working hours.

Lorsque des présomptions tirées notamment des conditions d’organisation du travail de tout ou partie des salariés employés dans une entreprise laissent craindre à l’inspecteur ou au contrôleur du travail que cet emploi constitue une infraction à la fois à l’interdiction de cumul d’emploi prévue à l’article L. 8261-1 et à la dérogation prévue à l’article L. 8261-3, il peut demander à l’employeur d’exiger des salariés désignés une attestation écrite certifiant qu’ils ne contreviennent pas à ces mêmes dispositions ou à celles relatives à la durée du travail.
