Payment service providers may not contractually restrict the possibility for a payee to apply charges, offer a discount to the payer or otherwise direct the payer to use a particular payment instrument. The charges applied may not exceed the direct costs incurred by the payee in using that payment instrument. Any stipulation to the contrary is deemed unwritten.
During the first quarter of each year, the payment service provider shall inform the payee, with the exception of natural persons not acting for business purposes, of a separate document summarising the total sums received by the payment service provider during the previous calendar year in respect of the contractually agreed charges for the collection of card payments. This annual statement of card payment collection fees distinguishes, for each category of products or services, the subtotal of fees collected and the number of corresponding products or services.
