Article L1128-7 of the French Public Health Code

Notwithstanding article 13 of the law of 16 and 24 August 1790 on the organisation of the judiciary, the judicial court alone has jurisdiction to rule on any action for compensation for damage resulting from research involving the human person; this action is time-barred under the conditions set out in article 2226 of the Civil Code.

Par dérogation à l’article 13 de la loi des 16 et 24 août 1790 sur l’organisation judiciaire, le tribunal judiciaire est seul compétent pour statuer sur toute action en indemnisation des dommages résultant d’une recherche impliquant la personne humaine ; cette action se prescrit dans les conditions prévues à l’article 2226 du code civil.
