Article L113-9 of the French Intellectual Property Code

Unless otherwise provided for in the articles of association or stipulated otherwise, the economic rights in software and its documentation created by one or more employees in the performance of their duties or on the instructions of their employer are vested in the employer, who alone is entitled to exercise them.

Any dispute on the application of this article shall be submitted to the judicial court of the employer’s registered office.

The provisions of the first paragraph of this article shall also apply to employees of the State, public authorities and public administrative establishments.

Sauf dispositions statutaires ou stipulations contraires, les droits patrimoniaux sur les logiciels et leur documentation créés par un ou plusieurs employés dans l’exercice de leurs fonctions ou d’après les instructions de leur employeur sont dévolus à l’employeur qui est seul habilité à les exercer.

Toute contestation sur l’application du présent article est soumise au tribunal judiciaire du siège social de l’employeur.

Les dispositions du premier alinéa du présent article sont également applicables aux agents de l’Etat, des collectivités publiques et des établissements publics à caractère administratif.
