Examination of a person’s genetic characteristics or identification by genetic fingerprinting for medical purposes may only be carried out in medical biology laboratories authorised for this purpose under the conditions laid down in Chapter II of Title II of Book I of Part Six and accredited under the conditions laid down in Chapter I of Title II of Book II of the same Part.
Where the laboratory is part of a health establishment, the authorisation shall be issued to that establishment.
A medical biology laboratory established in another Member State of the European Union or party to the Agreement on the European Economic Area may carry out the analytical phase of the examination of genetic characteristics or identification by genetic fingerprinting if it is authorised in that State to carry out this activity, provided that it has submitted a declaration if the conditions for authorisation in that State have previously been recognised as equivalent to those resulting from the first paragraph or, failing that, that it has obtained authorisation after verifying that its operating standards are equivalent to those resulting from the first paragraph.
