Where the Commission considers that a medical accident is only partly the consequence of preventive, diagnostic or therapeutic acts for which a healthcare professional or institution is liable, it will determine the proportion of the loss attributable to liability and the proportion for which compensation is payable by the Office.

Lorsque la commission estime qu’un accident médical n’est que pour partie la conséquence d’actes de prévention, de diagnostic ou de soins engageant la responsabilité d’un professionnel ou d’un établissement de santé, elle détermine la part de préjudice imputable à la responsabilité et celle relevant d’une indemnisation au titre de l’office.
