Article L1142-17-1 of the French Public Health Code

When the Regional Commission considers that the worsening of the damage resulting from a nosocomial infection causes the victim to suffer permanent physical or mental harm in excess of the percentage mentioned in 1° of article L. 1142-1-1 or death, the Office will make an offer of compensation to the victim or his heirs under the conditions set out in article L. 1142-17 and will reimburse the insurer for the compensation initially paid to the victim.

Article L1142-17-1

Lorsque la commission régionale estime que l’aggravation de dommages résultant d’une infection nosocomiale entraîne pour la victime un taux d’atteinte permanente à l’intégrité physique ou psychique supérieure au pourcentage mentionné au 1° de l’article L. 1142-1-1 ou son décès, l’office adresse à la victime ou à ses ayants droit une offre d’indemnisation dans les conditions prévues à l’article L. 1142-17 et rembourse à l’assureur les indemnités initialement versées à la victime.
