Article L1142-20 of the French Public Health Code

The victim, or his heirs, has the right to take legal action against the Office if no offer has been made to him or if he has not accepted the offer made to him.

The action for compensation is brought before the competent court according to the nature of the event giving rise to the damage.

La victime, ou ses ayants droit, dispose du droit d’action en justice contre l’office si aucune offre ne lui a été présentée ou si elle n’a pas accepté l’offre qui lui a été faite.

L’action en indemnisation est intentée devant la juridiction compétente selon la nature du fait générateur du dommage.
