Article L121-15 of the French Insurance Code

The insurance is void if, at the time of the contract, the insured object has already perished or can no longer be exposed to the risks.

The premiums paid must be returned to the insured, after deduction of the costs incurred by the insurer, other than commissions, where the latter have been recovered from the agent or broker.

In the case referred to in the first paragraph of this article, the party whose bad faith is proven owes the other party double the premium for one year.

L’assurance est nulle si, au moment du contrat, la chose assurée a déjà péri ou ne peut plus être exposée aux risques.

Les primes payées doivent être restituées à l’assuré, sous déduction des frais exposés par l’assureur, autres que ceux de commissions, lorsque ces derniers ont été récupérés contre l’agent ou le courtier.

Dans le cas mentionné au premier alinéa du présent article, la partie dont la mauvaise foi est prouvée doit à l’autre une somme double de la prime d’une année.
