Article L121-16 of the French Insurance Code

Any clause in insurance contracts which makes the payment of compensation for damage caused by a natural disaster within the meaning of article L. 125-1 to a built property conditional upon its reconstruction in situ is deemed to be unwritten where the area is subject to a plan for the prevention of foreseeable natural risks.

Toute clause des contrats d’assurance tendant à subordonner le versement d’une indemnité en réparation d’un dommage causé par une catastrophe naturelle au sens de l’article L. 125-1 à un immeuble bâti à sa reconstruction sur place est réputée non écrite dès lors que l’espace est soumis à un plan de prévention des risques naturels prévisibles.
