Article L121-4 of the French Monetary and Financial Code

The public establishment La Monnaie de Paris is governed by the provisions of law no. 83-675 of 26 July 1983 relating to the democratisation of the public sector, which apply to the establishments mentioned in article 1.

With a view to electing their representatives to the Board of Directors, the staff of the establishment are, by way of derogation from chapter II of title II of the aforementioned law no. 83-675 of 26th July 1983, divided into several colleges under conditions that ensure the representation of all categories of staff.

Notwithstanding article 9 of law no. 83-634 of 13 July 1983 on the rights and obligations of civil servants and chapter II of law no. 84-16 of 11 January 1984 on statutory provisions relating to the State civil service, technical civil servants working for the public establishment La Monnaie de Paris participate in its organisation and operation as well as in the management of its social action, through the representative institutions provided for in titles II and III of book IV of the Labour Code. Adaptations justified by the particular situation of these technical civil servants may be made by a Conseil d’Etat decree.

Article L121-4

L’établissement public La Monnaie de Paris est régi par les dispositions de la loi n° 83-675 du 26 juillet 1983 relative à la démocratisation du secteur public qui s’appliquent aux établissements mentionnés au 1 de son article 1er.

En vue de l’élection de leurs représentants au conseil d’administration, les personnels de l’établissement sont, par dérogation au chapitre II du titre II de la loi n° 83-675 du 26 juillet 1983 précitée, répartis en plusieurs collèges dans des conditions propres à assurer la représentation de toutes les catégories de personnels.

Par dérogation à l’article 9 de la loi n° 83-634 du 13 juillet 1983 portant droits et obligations des fonctionnaires et au chapitre II de la loi n° 84-16 du 11 janvier 1984 portant dispositions statutaires relatives à la fonction publique de l’Etat, les fonctionnaires techniques en fonction dans l’établissement public La Monnaie de Paris participent à son organisation et à son fonctionnement ainsi qu’à la gestion de son action sociale, par l’intermédiaire des institutions représentatives prévues aux titres II et III du livre IV du code du travail. Des adaptations justifiées par la situation particulière de ces fonctionnaires techniques peuvent être apportées par un décret en Conseil d’Etat.
