Article L121-5 of the French Insurance Code

If the estimates show that the value of the insured item on the date of the loss exceeds the sum insured, the insured shall be deemed to remain his own insurer for the excess, and shall consequently bear a proportionate share of the loss, unless otherwise agreed.

S’il résulte des estimations que la valeur de la chose assurée excède au jour du sinistre la somme garantie, l’assuré est considéré comme restant son propre assureur pour l’excédent, et supporte, en conséquence, une part proportionnelle du dommage, sauf convention contraire.
