Article L1221-9 of the French Public Health Code

An order by the ministers responsible for health and social security sets the prices for the sale of labile blood products, with the exception of plasmas for transfusion purposes covered by 1° of article L. 1221-8.

For Guadeloupe, French Guyana, Martinique, Mayotte and La Réunion and for Saint-Barthélemy and Saint-Martin, an order from the ministers responsible for overseas departments and territories, health and social security may determine increases to the prices set in application of the previous paragraph. These increases take into account the specific costs which, in each of these departments, increase the cost of labile blood products compared to their cost in mainland France.

Un arrêté des ministres chargés de la santé et de la sécurité sociale fixe les tarifs de cession des produits sanguins labiles, à l’exception des plasmas à finalité transfusionnelle relevant du 1° de l’article L. 1221-8.

Pour la Guadeloupe, la Guyane, la Martinique, Mayotte et La Réunion et pour Saint-Barthélemy et Saint-Martin, un arrêté des ministres chargés de l’outre-mer, de la santé et de la sécurité sociale peut déterminer des majorations aux tarifs fixés en application de l’alinéa précédent. Ces majorations prennent en compte les frais particuliers qui, dans chacun de ces départements, grèvent le coût des produits sanguins labiles par rapport à leur coût en métropole.
