Article L1225-4-4 of the French Labour Code

No employer may terminate an employee’s employment contract during the parental presence leave provided for in article L. 1225-62 or during periods worked if the parental presence leave is split or taken on a part-time basis.

However, the employer may terminate the contract if it can prove that the employee is guilty of serious misconduct or that it is impossible to continue the contract for a reason unrelated to the state of health of the employee’s child.

Aucun employeur ne peut rompre le contrat de travail d’un salarié pendant un congé de présence parentale prévu à l’article L. 1225-62 ni pendant les périodes travaillées si le congé de présence parentale est fractionné ou pris à temps partiel.


Toutefois, l’employeur peut rompre le contrat s’il justifie d’une faute grave de l’intéressé ou de son impossibilité de maintenir ce contrat pour un motif étranger à l’état de santé de l’enfant de l’intéressé.
