Article L1225-5 of the French Labour Code

An employee’s dismissal is cancelled if, within fifteen days of being notified of the dismissal, she sends her employer a medical certificate stating that she is pregnant, in accordance with the conditions determined by regulation.

These provisions do not apply when the dismissal is for serious misconduct unrelated to the pregnancy or because it is impossible to continue the contract for a reason unrelated to the pregnancy or childbirth.

Le licenciement d’une salariée est annulé lorsque, dans un délai de quinze jours à compter de sa notification, l’intéressée envoie à son employeur, dans des conditions déterminées par voie réglementaire, un certificat médical justifiant qu’elle est enceinte.

Ces dispositions ne s’appliquent pas lorsque le licenciement est prononcé pour une faute grave non liée à l’état de grossesse ou par impossibilité de maintenir le contrat pour un motif étranger à la grossesse ou à l’accouchement.
