Any employee with one year’s seniority in the company is entitled, in the event of absence from work justified by incapacity resulting from illness or accident as certified by a medical certificate and, if necessary, a counter-check, to an allowance in addition to the daily allowance provided for in article L. 321-1 of the Social Security Code, provided that:
1° Providing proof of such incapacity within forty-eight hours, unless the employee is one of the persons mentioned in article L. 169-1 of the Social Security Code ;
2° Be covered by social security;
3° Be treated in France or in one of the other Member States of the European Community or in one of the other States party to the Agreement on the European Economic Area.
These provisions do not apply to employees working from home, seasonal employees, intermittent employees or temporary employees.
A decree of the Council of State determines the forms and conditions of the secondary inspection mentioned in the first paragraph.
The rate, deadlines and methods of calculating the additional compensation are determined by regulation.
