Article L1226-19 of the French Labour Code

Periods during which the employment contract is suspended as a result of an accident at work or occupational illness do not prevent the fixed-term employment contract from expiring.

However, where the contract includes a renewal clause, the employer may only refuse to renew the contract during the periods of suspension if he can prove a real and serious reason unrelated to the accident or illness. Failing this, the employer shall pay the employee compensation corresponding to the loss suffered, which may not be less than the amount of salary and benefits that the employee would have received until the end of the renewal period provided for in the contract.

Les périodes de suspension du contrat de travail consécutives à un accident du travail ou à une maladie professionnelle ne font pas obstacle à l’échéance du contrat de travail à durée déterminée.

Toutefois, lorsque ce contrat comporte une clause de renouvellement, l’employeur ne peut, au cours des périodes de suspension, refuser le renouvellement que s’il justifie d’un motif réel et sérieux, étranger à l’accident ou à la maladie. A défaut, il verse au salarié une indemnité correspondant au préjudice subi, qui ne peut être inférieure au montant des salaires et avantages que le salarié aurait reçus jusqu’au terme de la période de renouvellement prévue au contrat.
