Any legal entity is authorised to set up its registered office at the domicile of its legal representative and carry on business there, unless otherwise provided by law or contractual stipulations.
Where the legal entity is subject to the law or contractual stipulations mentioned in the previous paragraph, its legal representative may set up its registered office at his domicile, for a period that may not exceed five years from the date of its creation, nor exceed the legal, contractual or judicial term of occupancy of the premises.
In this case, it must, prior to filing its application for registration or amendment of registration, notify the lessor, the co-ownership syndicate or the representative of the property complex in writing of its intention to make use of the option thus provided.
Before expiry of the period referred to in the second paragraph, the person must, on pain of automatic striking off, provide the court registry with the information justifying his change of situation, in accordance with the procedures laid down by decree in the Conseil d’Etat.
The provisions of this article may not result in a change of use of the property, nor in the application of the status of commercial leases.
