A person subject to registration who has not applied for registration by the end of a period of fifteen days from the commencement of his activity may not, until he is registered, rely on the status of trader with regard to third parties or public administrations. However, it may not invoke its failure to be entered in the register to evade the responsibilities and obligations inherent in that status.
Without prejudice to the application of Article L. 144-7, a registered trader who disposes of his business or who grants the right to operate it, in particular in the form of a management lease, may only plead cessation of his commercial activity in order to avoid liability claims against him arising from the obligations contracted by his successor in operating the business, from the day on which the striking off or the corresponding entry was made.
