Article L1233-24-3 of the French Labour Code

The agreement provided for in Article L. 1233-24-1 may not derogate from :

1° The employer’s obligation to provide training, adaptation and redeployment in application of article L. 1233-4;

2° The general rules for informing and consulting the social and economic committee set out in articles L. 2323-2, L. 2323-4 and L. 2323-5 , except where the agreement is concluded by the works council;

3° The employer’s obligation to offer employees the professional security contract provided for in article L. 1233-65 or the redeployment leave provided for in article L. 1233-71 ;

4° Communication to staff representatives of the information provided for in Articles L. 1233-31 to L. 1233-33;

5° Consultation rules applicable in the event of receivership or compulsory liquidation, as provided for in Article L. 1233-58.

L’accord prévu à l’article L. 1233-24-1 ne peut déroger :

1° A l’obligation d’effort de formation, d’adaptation et de reclassement incombant à l’employeur en application de l’article L. 1233-4 ;

2° Aux règles générales d’information et de consultation du comité social et économique prévues aux articles L. 2323-2, L. 2323-4 et L. 2323-5 sauf lorsque l’accord est conclu par le conseil d’entreprise ;

3° A l’obligation, pour l’employeur, de proposer aux salariés le contrat de sécurisation professionnelle prévu à l’article L. 1233-65 ou le congé de reclassement prévu à l’article L. 1233-71 ;

4° A la communication aux représentants du personnel des renseignements prévus aux articles L. 1233-31 à L. 1233-33 ;

5° Aux règles de consultation applicables lors d’un redressement ou d’une liquidation judiciaire, prévues à l’article L. 1233-58.
