Article L1233-57-10 of the French Labour Code

Together with the notice of the meeting provided for in article L. 1233-57-9, the employer shall send the employee representatives all relevant information on the proposed closure of the establishment.

In particular, it shall indicate:

1° The economic, financial or technical reasons for the proposed closure;

2° The steps it intends to take to find a buyer;

3° The possibilities for employees to submit a takeover offer, the various possible takeover models, in particular through the companies provided for by law no. 78-763 of 19 July 1978 on the status of cooperative production companies, as well as the right of staff representatives to have recourse to an expert as provided for in article L. 1233-57-17.

L’employeur adresse aux représentants du personnel, avec la convocation à la réunion prévue à l’article L. 1233-57-9, tous renseignements utiles sur le projet de fermeture de l’établissement.


Il indique notamment :


1° Les raisons économiques, financières ou techniques du projet de fermeture ;


2° Les actions qu’il envisage d’engager pour trouver un repreneur ;


3° Les possibilités pour les salariés de déposer une offre de reprise, les différents modèles de reprise possibles, notamment par les sociétés prévues par la loi n° 78-763 du 19 juillet 1978 portant statut des sociétés coopératives de production, ainsi que le droit des représentants du personnel de recourir à un expert prévu à l’article L. 1233-57-17.
