Article L1233-57-6 of the French Labour Code

The administration may, at any time during the procedure, make any observation or proposal to the employer concerning the conduct of the procedure or the social measures provided for in article L. 1233-32. It shall simultaneously send a copy of its observations to the social and economic committee and, where negotiation of the agreement referred to in article L. 1233-24-1 is underway, where applicable to the representative trade union organisations in the company.

The employer responds to these observations and sends a copy of its response to the staff representatives and, where applicable, to the trade union organisations.

L’administration peut, à tout moment en cours de procédure, faire toute observation ou proposition à l’employeur concernant le déroulement de la procédure ou les mesures sociales prévues à l’article L. 1233-32. Elle envoie simultanément copie de ses observations au comité social et économique et, lorsque la négociation de l’accord visé à l’article L. 1233-24-1 est engagée, le cas échéant aux organisations syndicales représentatives dans l’entreprise.

L’employeur répond à ces observations et adresse copie de sa réponse aux représentants du personnel et, le cas échéant, aux organisations syndicales.
