Article L1237-15 of the French Labour Code

Employees benefiting from the protection mentioned in articles L. 2411-1 and L. 2411-2 may benefit from the provisions of this section. Notwithstanding the provisions of article L. 1237-14, the contractual termination is subject to authorisation by the Labour Inspector under the conditions set out in Chapter I of Title I of Book IV, Section 1 of Chapter I and Chapter II of Title II of Book IV of Part Two. In this case, and notwithstanding the provisions of article L. 1237-13, the employment contract may only be terminated on the day following the date of authorisation.

In the case of company doctors, termination by agreement is subject to authorisation by the Labour Inspector, after obtaining the opinion of the Labour Inspector.

Article L1237-15

Les salariés bénéficiant d’une protection mentionnés aux articles L. 2411-1 et L. 2411-2 peuvent bénéficier des dispositions de la présente section. Par dérogation aux dispositions de l’article L. 1237-14, la rupture conventionnelle est soumise à l’autorisation de l’inspecteur du travail dans les conditions prévues au chapitre Ier du titre Ier du livre IV, à la section 1 du chapitre Ier et au chapitre II du titre II du livre IV de la deuxième partie. Dans ce cas, et par dérogation aux dispositions de l’article L. 1237-13, la rupture du contrat de travail ne peut intervenir que le lendemain du jour de l’autorisation.

Pour les médecins du travail, la rupture conventionnelle est soumise à l’autorisation de l’inspecteur du travail, après avis du médecin inspecteur du travail.
