Where the sale of these assets has not taken place by public auction, the purchaser who wishes to secure himself from the proceedings of the registered creditors is required, on pain of forfeiture and at the latest within fifteen days of the summons to pay being served on him, to notify all these creditors at the address they have elected in their registrations: his surname, first names and address, the purchase price, the list and amount of preferential claims with a declaration that he is prepared to pay them forthwith up to the amount of his price.
Any registered creditor may request the sale by public auction of the assets transferred by mutual agreement, offering to increase the price by one tenth and to provide security for the payment of the price and charges or to prove sufficient solvency.
This request must be served on the purchaser and the debtor who was the previous owner within fifteen days of the notification referred to in the first paragraph of this article and must contain a summons to appear before the Commercial Court of Paris to obtain a ruling that the assets are to be sold by public auction.
