Tissues from the human body may only be removed with a view to donation for therapeutic purposes in health establishments authorised for this purpose by the administrative authority after obtaining the opinion of the Agence de la biomédecine.
Cells for autologous or allogeneic administration may only be collected in health establishments authorised for this purpose by the Director General of the Regional Health Agency after obtaining the opinion of the Biomedicine Agency. Blood cells intended for the preparation of cellular products for therapeutic purposes mentioned in Article L. 1243-1 may also be collected by the Etablissement Français du Sang either in its blood transfusion establishments, if they have been authorised under the conditions applicable to health establishments, or in authorised health establishments.
By way of derogation from the previous paragraph, the categories of cells on a list drawn up by the Minister for Health, on a proposal from the Agence nationale de sécurité du médicament et des produits de santé and after receiving the opinion of the Agence de la biomédecine, may be taken for autologous administration in all health establishments and by doctors and dental surgeons practising outside health establishments, provided that the samples are taken in compliance with the rules of good practice drawn up under the same conditions.
The authorisations provided for in the first and second paragraphs are issued for a period of five years. They are renewable.
