Article L1243-9 of the French Public Health Code

The terms and conditions for the application of this chapter shall be determined by decree in the Conseil d’Etat, and in particular :

1° The high-cost activities or activities requiring special provisions in the interests of public health provided for in article L. 1243-6 ;

2° The conditions and procedures for issuing the authorisations provided for in articles L. 1243-2 and L. 1243-6, as well as the conditions for modification of these authorisations by the competent administrative authority, in particular the list of modifications that must be covered by the authorisation provided for in the third paragraph of article L. 1243-2, as well as the conditions for suspension or withdrawal of these authorisations by the competent administrative authority;

3° Where necessary, the rules, in particular financial and economic rules, to ensure compliance with the provisions of Title I of this Book applicable to the preparation, preservation, processing, distribution and transfer of tissues and cell therapy preparations.

Article L1243-9

Les modalités d’application du présent chapitre sont déterminées par décret en Conseil d’Etat, et notamment :

1° Les activités d’un coût élevé ou nécessitant des dispositions particulières dans l’intérêt de la santé publique prévues à l’article L. 1243-6 ;

2° Les conditions et les modalités de délivrance des autorisations prévues aux articles L. 1243-2 et L. 1243-6, ainsi que les conditions de modification de ces autorisations par l’autorité administrative compétente, notamment la liste des modifications devant faire l’objet de l’autorisation prévue au troisième alinéa de l’article L. 1243-2, ainsi que les conditions, de suspension ou de retrait de ces autorisations par l’autorité administrative compétente ;

3° En tant que de besoin, les règles, notamment financières et économiques, propres à assurer le respect des dispositions du titre Ier du présent livre applicables à la préparation, la conservation, la transformation, la distribution et la cession des tissus et des préparations de thérapie cellulaire.
