A fine of 3,750 euros shall be imposed on any user who makes use of a temporary employee :
1° Either without having concluded a written secondment contract with a temporary employment agency, within the period stipulated in Article L. 1251-42 ;
2° Or by failing to communicate, in the secondment contract, all the elements of remuneration in accordance with 6° of article L. 1251-43.
A repeat offence is punishable by six months’ imprisonment and a fine of €7,500.
