Article L1255-10 of the French Labour Code

A fine of 3,750 euros shall be imposed on any user who makes use of a temporary employee :

1° Either without having concluded a written secondment contract with a temporary employment agency, within the period stipulated in Article L. 1251-42 ;

2° Or by failing to communicate, in the secondment contract, all the elements of remuneration in accordance with 6° of article L. 1251-43.

A repeat offence is punishable by six months’ imprisonment and a fine of €7,500.

Est puni d’une amende de 3 750 euros, le fait pour l’utilisateur de recourir à un salarié temporaire :

1° Soit sans avoir conclu avec un entrepreneur de travail temporaire un contrat écrit de mise à disposition, dans le délai prévu à l’article L. 1251-42 ;

2° Soit en ayant omis de communiquer, dans le contrat de mise à disposition, l’ensemble des éléments de rémunération conformément au 6° de l’article L. 1251-43.

La récidive est punie d’un emprisonnement de six mois et d’une amende de 7 500 euros.
