Section 1: Temporary work.

Failure to comply with the provisions relating to the conditions under which temporary work is carried out, as set out in article L. 1251-2, is punishable by a fine of 3,750 euros. Any user who, in breach of article L. 1251-5, concludes a secondment contract with the purpose or effect of permanently filling a job linked to the normal and permanent activity of the company, is liable to a fine of 3,750 euros. A repeat offence is punishable by six months’ imprisonment and a fine of €7,500.

Any user who uses a temporary employee for a purpose other than that provided for in the first paragraph of article L. 1251-6 or outside the cases mentioned in that same article is liable to a fine of 3,750 euros. A repeat offence is punishable by six months’ imprisonment and a fine of 7,500 euros.

Failure by the user to comply with the provisions relating to the succession of contracts on the same job, as provided for by the stipulations of the agreement or industry-level agreement concluded pursuant toarticle L. 1251-36 or, where applicable, the provisions ofarticle L. 1251-36-1, is punishable by a fine of 3,750 euros. A repeat offence is punishable by six months’ imprisonment and a fine of 7,500 euros.

A fine of 3,750 euros shall be imposed on any user who makes use of a temporary employee : 1° Either without having concluded a written secondment contract with a temporary employment agency, within the period stipulated in Article L. 1251-42 ; 2° Or by failing to communicate, in the secondment contract, all the elements of remuneration in accordance with 6° of article L. 1251-43.
