Insurance contracts covering fire damage to property located on national territory and damage to the bodies of land motor vehicles entitle the insured party to cover for direct material damage caused to insured property by an attack or act of terrorism as defined by articles 421-1 and 421-2 of the Criminal Code suffered on national territory.
Compensation for material damage, including decontamination costs, and compensation for consequential non-material damage are covered within the deductible and ceiling limits set in the policy for fire cover.
When it is necessary to decontaminate a property, compensation for damage, including decontamination costs, cannot exceed the market value of the property or the amount of the insured capital.
In addition, if the insured is covered for business interruption, this cover is extended to cover damage caused by attacks and acts of terrorism, under the conditions set out in the policy.
Decontamination and containment of excavated material do not fall within the scope of this cover.
Any clause to the contrary is deemed unwritten.
A decree of the Conseil d’Etat shall determine any derogations or exclusions applicable to contracts concerning the major risks defined in article L. 111-6 with regard to the insurability of these risks.
