Article L1263-4-1 of the French Labour Code

The Labour Inspectorate control officer or the equivalent control officer mentioned in the last paragraph of Article L. 8112-1 who has not received, by the end of the period of forty-eight hours from the start of the posting of an employee, the posting declaration mentioned in the second paragraph of I of Article L. 1262-4-1 may submit a reasoned report to the competent administrative authority. The latter may order, in view of the seriousness of the breach, by reasoned decision, the suspension of the provision of services for a period not exceeding one month.

The administrative authority shall put an end to the suspension as soon as it receives the posting declaration sent by the employer, the principal or the project owner, for the employees concerned.

The penalty provided for in the first paragraph of this article may be combined with the administrative fine provided for in articles L. 1264-1 and L. 1264-2.

A decree of the Conseil d’Etat shall determine the terms and conditions of application of this article.

Article L1263-4-1

L’agent de contrôle de l’inspection du travail ou l’agent de contrôle assimilé mentionné au dernier alinéa de l’article L. 8112-1 qui n’a pas reçu, à l’issue du délai de quarante-huit heures à compter du début du détachement d’un salarié, la déclaration de détachement mentionnée au deuxième alinéa du I de l’article L. 1262-4-1 peut saisir d’un rapport motivé l’autorité administrative compétente. Celle-ci peut ordonner, au regard de la gravité du manquement, par décision motivée, la suspension de la réalisation de la prestation de services, pour une durée ne pouvant excéder un mois.

L’autorité administrative met fin à la suspension dès la réception de la déclaration de détachement transmise par l’employeur, le donneur d’ordre ou le maître d’ouvrage, pour les salariés concernés.

La sanction prévue au premier alinéa du présent article peut être cumulée avec l’amende administrative prévue aux articles L. 1264-1 et L. 1264-2.

Un décret en Conseil d’Etat détermine les modalités d’application du présent article.
