Article L127-5 of the French Commercial code

The business project support contract for the creation or takeover of an economic activity may not have the purpose or effect of breaching the provisions of articles L. 125-1, L. 125-3,L. 324-9 or L. 324-10 of the Labour Code.

The act of creating or taking over a business must be clearly distinguished from the support function.

Le contrat d’appui au projet d’entreprise pour la création ou la reprise d’une activité économique ne peut avoir pour objet ou pour effet d’enfreindre les dispositions des articles L. 125-1, L. 125-3,L. 324-9 ou L. 324-10 du code du travail.

L’acte de création ou de reprise d’entreprise doit être clairement distingué de la fonction d’accompagnement.
