State employees or public servants remunerated by the State may work as technical sports advisors for approved federations, in accordance with procedures defined by decree in the Conseil d’Etat. The federations may pay them compensation for these duties, subject to the limits and conditions laid down by decree.
For the duration of their assignments, sports technical advisors remain under the exclusive hierarchical authority of the Minister for Sport or the head of the decentralised department to which they report. In the performance of their duties, they cannot be considered to be linked to the federation by a relationship of subordination characteristic of a contract of employment within the meaning of Book II of Part One of the Labour Code.
For the performance of their duties and by derogation fromarticle 3 of law no. 83-634 of 13 July 1983 on the rights and obligations of civil servants, when they have the status of civil servants, these agents, when they perform the duties of national technical director, assistant national technical director or national coach, may be seconded on a public law contract, in the corresponding posts, under the conditions and according to the procedures laid down by the decree provided for in the first paragraph of this article.
