Article L131-28 of the French Commercial code

Sworn merchandise brokers are competent, unless the court appoints a judicial auctioneer or another public officer, to conduct the following public sales:

1° Wholesale sales of goods authorised or ordered by the commercial court under the conditions provided for in articles L. 322-14 et seq.;

2° Sales of the debtor’s goods in the event of compulsory liquidation under the conditions provided for in articles L. 642-19 et seq;

3° Sales on realisation of a pledge under the conditions provided for in the second paragraph of Article 2346 of the Civil Code.

Article L131-28

Les courtiers de marchandises assermentés sont compétents, sauf désignation par le tribunal d’un commissaire-priseur judiciaire ou d’un autre officier public, pour procéder aux ventes publiques suivantes :

1° Ventes de marchandises en gros autorisées ou ordonnées par le tribunal de commerce dans les conditions prévues aux articles L. 322-14 et suivants ;

2° Ventes des marchandises du débiteur en cas de liquidation judiciaire dans les conditions prévues aux articles L. 642-19 et suivants ;

3° Ventes sur réalisation de gage dans les conditions prévues au deuxième alinéa de l’article 2346 du code civil.
