The drawee must pay even after the expiry of the presentation period. He must also pay even if the cheque was issued in breach of the injunction provided for in Article L. 131-73 or the prohibition provided for in the second paragraph of Article L. 163-6.
Payment by cheque may only be stopped in the event of loss, theft or fraudulent use of the cheque, or in the event of the bearer’s bankruptcy, receivership or liquidation proceedings. The drawer must immediately confirm his stop payment in writing, regardless of the medium used.
All bankers must inform account holders in writing of the penalties incurred in the event of a stop payment being made for reasons other than those set out in this article.
If, despite this defence, the drawer lodges a stop payment on other grounds, the summary proceedings judge, even if the main proceedings have been initiated, must, at the request of the bearer, order the stop payment to be discharged.
