Where a cheque is payable in a currency that is not a legal tender in France, the amount of the cheque may be paid, within the time limit for presentation of the cheque, on the basis of its value in euros on the day of payment. If payment has not been made when the cheque is presented, the bearer may, at his or her option, request that the amount of the cheque be paid in a currency that is current in France at the exchange rate prevailing either on the day of presentation or on the day of payment.
French practice for the quotation of the various foreign currencies in which cheques are denominated must be followed in order to determine the value of these currencies in French currency. However, the drawer may stipulate that the sum to be paid shall be calculated on the basis of a rate specified in the cheque.
The above rules do not apply where the drawer stipulates an effective payment clause in a foreign currency.
If the amount of the cheque is stated in a currency having the same denomination, but a different value, in the country of issue and in the country of payment, reference is presumed to have been made to the currency of the place of payment.
