Article L131-40 of the French Monetary and Financial Code

If a cheque is lost, the person to whom it belongs may pursue payment from a second, third, fourth, etc. cheque.

If the person who lost the cheque cannot represent the second, third, fourth, etc., he may request payment of the lost cheque and obtain it by order of the judge by proving his ownership by his books and by giving security.

In all the provisions of this chapter relating to the loss of a cheque, theft is treated in the same way as loss.

En cas de perte du chèque, celui à qui il appartient peut en poursuivre le paiement sur un second, troisième, quatrième, etc.

Si celui qui a perdu le chèque ne peut représenter le second, troisième, quatrième, etc, il peut demander le paiement du chèque perdu et l’obtenir par ordonnance du juge en justifiant de sa propriété par ses livres et en donnant caution.

Dans toutes les dispositions du présent chapitre relatives à la perte du chèque, le vol est assimilé à la perte.
