Article L131-78 of the French Monetary and Financial Code

The holder of an account who has been served with an injunction to stop issuing cheques shall recover this right as soon as he has regularised the situation in accordance with the conditions set out in Article L. 131-73. If the account holder has not rectified the situation, the right to issue cheques will not be restored until five years have elapsed from the date of the injunction.

Le titulaire d’un compte auquel a été notifiée une injonction de ne plus émettre des chèques recouvre cette faculté dès lors qu’il a procédé à la régularisation dans les conditions prévues à l’article L. 131-73. S’il n’a pas procédé à cette régularisation, il ne recouvre la faculté d’émettre des chèques qu’à l’issue d’un délai de cinq ans qui court à compter de l’injonction.
