Article L131-83 of the French Monetary and Financial Code

A drawee who has paid a cheque despite the absence, insufficiency or unavailability of funds shall, except in the case provided for in the first paragraph of II of Article L. 131-81, be subrogated to the rights of the bearer to the extent of the sum advanced by the drawee; to this end, the drawee may have the absence or insufficiency of the available funds recorded by a deed drawn up in the form of a protest.

In the absence of an automatic deduction from the account and without prejudice to any other legal remedy, it may serve formal notice by bailiff on the account holder to pay the sum due to it pursuant to the preceding paragraph.

Le tiré qui a payé un chèque en dépit de l’absence, de l’insuffisance ou de l’indisponibilité de la provision est, sauf dans le cas prévu au premier alinéa du II de l’article L. 131-81, subrogé dans les droits du porteur à concurrence de la somme dont il a fait l’avance ; il peut, à cet effet, faire constater l’absence ou l’insuffisance de la provision disponible par acte dressé en la forme du protêt.

Il peut, à défaut de prélèvement d’office sur le compte et sans préjudice de toute autre voie de droit, faire une mise en demeure par huissier de justice au titulaire du compte d’avoir à payer la somme qui lui est due en application de l’alinéa précédent.
