Article L1313-10 of the French Public Health Code

I.-The contractual agents mentioned in article L. 1313-8 :

1° Are bound by professional secrecy and discretion under the same conditions as those defined in article 26 of title I of the general status of civil servants;

2° May not, either themselves or through an intermediary, have any interest in the companies or establishments associated with the agency that could compromise their independence;

3° Are subject to Articles 25 to 25 octies of Law No. 83-634 of 13 July 1983 relating to the rights and obligations of civil servants.

II and III (paragraphs repealed)

IV -Agency employees, members of committees, councils and commissions and persons who occasionally provide assistance to the agency or to these bodies are bound by professional secrecy with regard to information that may have come to their knowledge by virtue of their duties, under the conditions and subject to the penalties laid down in articles 226-13 and 226-14 of the French Penal Code.

Article L1313-10

I.-Les agents contractuels mentionnés à l’article L. 1313-8 :

1° Sont tenus au secret et à la discrétion professionnels dans les mêmes conditions que celles qui sont définies à l’article 26 du titre Ier du statut général des fonctionnaires ;

2° Ne peuvent, par eux-mêmes ou par personne interposée, avoir, dans les entreprises ou établissements en relation avec l’agence, aucun intérêt de nature à compromettre leur indépendance ;

3° Sont soumis aux articles 25 à 25 octies de la loi n° 83-634 du 13 juillet 1983 relative aux droits et obligations des fonctionnaires.

II. et III. (alinéas abrogés)

IV.-Les agents de l’agence, les membres des comités, conseils et commissions et les personnes qui apportent occasionnellement leur concours à l’agence ou à ces instances sont astreints au secret professionnel pour les informations dont ils ont pu avoir connaissance en raison de leurs fonctions, dans les conditions et sous les peines prévues aux articles 226-13 et 226-14 du code pénal.
