Article L132-11 of the French Consumer Code

The aggressive commercial practices referred to in articles L. 121-6 and L. 121-7 are punishable by two years’ imprisonment and a fine of 300,000 euros.

The amount of the fine may be increased, in proportion to the benefits derived from the offence, to 10% of the average annual turnover, calculated on the basis of the last three annual turnover figures known on the date of the offence.

In the event of conviction, the court shall order, by all appropriate means, the display or dissemination of all or part of the decision or of a press release informing the public of the reasons for and the operative part of the decision.

Les pratiques commerciales agressives mentionnées aux articles L. 121-6 et L. 121-7 sont punies d’un emprisonnement de deux ans et d’une amende de 300 000 euros.


Le montant de l’amende peut être porté, de manière proportionnée aux avantages tirés du délit, à 10 % du chiffre d’affaires moyen annuel, calculé sur les trois derniers chiffres d’affaires annuels connus à la date des faits.

En cas de condamnation, le tribunal ordonne, par tous moyens appropriés, l’affichage ou la diffusion de l’intégralité ou d’une partie de la décision ou d’un communiqué informant le public des motifs et du dispositif de celle-ci.
