Article L132-30 of the French Insurance Code

Contracts involving the acquisition of real estate by means of the constitution of life annuities are subject to the provisions of this article.

The annuitants individually retain, for the service of their annuities, even against any agreement to the contrary, the legal mortgage of 1° of article 2402 of the Civil Code on the assigned property. If there are heirs in the direct line of the creditors, they may only deal with the insurer after having been authorised to do so by a judgement handed down in chambers on a simple petition.

The estimate of the current value, in full ownership, of the transferred buildings, is expressly stipulated in the life annuity contracts and guaranteed to be sincere and true by an expert appointed by the judicial court of the jurisdiction of the said buildings. The expert’s certificate, followed by his signature, appears in the contracts.

Les contrats comportant des opérations d’acquisition d’immeubles au moyen de la constitution de rentes viagères sont soumis aux dispositions du présent article.

Les crédirentiers conservent individuellement pour le service de leurs rentes, même à l’encontre de toute convention contraire, l’hypothèque légale du 1° de l’article 2402, du code civil sur l’immeuble cédé. S’il existe des héritiers en ligne directe des crédirentiers, ces derniers ne peuvent traiter avec l’assureur qu’après y avoir été autorisés par jugement rendu en chambre du conseil sur simple requête.

L’estimation de la valeur actuelle, en pleine propriété, des immeubles cédés, est expressément stipulée aux contrats de rentes viagères et garantie sincère et véritable par un expert désigné par le tribunal judiciaire du ressort desdits immeubles. L’attestation de l’expert, suivie de sa signature, figure aux contrats.
