Any natural person who has signed an application or a life insurance or capitalisation contract may cancel it by registered letter or by electronic registered mail, with acknowledgement of receipt, within a period of thirty calendar days from the date on which they are informed that the contract has been concluded. This period expires at midnight on the last day. If it expires on a Saturday, Sunday or public holiday, it is not extended.
If the policy is surrendered, the insurance or capitalisation company will return all sums paid by the policyholder within a maximum period of thirty full calendar days from receipt of the registered letter or electronic registered letter. After this period, any sums not returned shall automatically accrue interest at half the legal rate for a period of two months and then, on expiry of this two-month period, at double the legal rate.
The provisions of this article are specified, where necessary, by ministerial decree.
They do not apply to contracts of a maximum duration of two months.
