When a conceding authority decides to enter into a single contract even though this contract relates to objectively separable services that fall under both the ordinary law governing concession contracts as set out in Book I of Part Three and the ordinary law governing contracts as set out in Book I of Part Two or Book II relating to partnership contracts, this contract is subject to the provisions of article L. 1321-1.
Where the purpose of the contract is to carry out several activities, only one of which constitutes a network operator activity, it is subject to the provisions applicable to its main purpose. Where the main purpose of the contract cannot be objectively determined, the contract is subject to the provisions of Books I or II of Part Two.
