In the event of total or partial abandonment of the assets made available pursuant to articles L. 1321-1 and L. 1321-2, the owning local authority recovers all its rights and obligations over the disused assets.
The local authority benefiting from the disposal may, at its request, become the owner of the disused assets, where these do not form part of the public domain, at a price corresponding to their market value. This price may be:
-decreased by the increase in value conferred on the assets by the work carried out by the authority benefiting from the transfer and by the charges, borne by it, resulting from loans contracted for the acquisition of these assets by the authority previously responsible;
-increased by the decrease in value resulting from the failure of the authority benefiting from the transfer to maintain the said assets.
Failing agreement on the price, it is set by the expropriation judge.
