The health monitoring of water intended for human consumption, which is the responsibility of the State, includes water sampling and analysis carried out by the regional health agency or a laboratory approved by the Director General of the National Agency for Food, Environmental and Occupational Health Safety, with the exception of radioactivity analyses which are carried out by a laboratory approved by the Minister for Health. A laboratory established in another Member State of the European Community or party to the Agreement on the European Economic Area may carry out these samples and analyses if it can demonstrate equivalent resources, quality of practice and control methods, verified by the Director General of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail. The laboratory is chosen by the Director General of the Regional Health Agency. These analyses are carried out either as part of the monitoring programme mentioned in c of 1° of Article L. 1431-2, or at the request of the State representative in the department, or on the initiative of the Director General of the Regional Health Agency.
The Director General of the Regional Health Agency is responsible for organising health monitoring of water. To this end, he shall enter into the necessary contract with one or more laboratories meeting the conditions set out in the first paragraph. He is the contracting authority.
The laboratory holding the contract is responsible for recovering the sums relating to water health monitoring sampling and analysis from the public or private entity responsible for water production or distribution.
